General Terms and Conditions of Sale

1. Seller Identity

These General Terms and Conditions of Sale (GTCS) are entered into between the consumer customer and:

2. Purpose

These GTCS govern the sale, through the aurea-logica.com website, of digital content, including electronic books (“ebooks”).

The products are digital content supplied without a physical medium.

The essential characteristics of each product, including its title and available formats, are presented to the customer before the order is placed.

3. Acceptance of the GTCS

The customer may consult these GTCS before proceeding with payment.

Validation of the order constitutes acceptance of the GTCS applicable to the order.

The applicable GTCS are those in force at the time the order is placed.

When payment is made through Stripe Checkout, acceptance of the terms may be collected directly through the payment interface.

4. Prices

Prices are stated in euros, including all applicable taxes (VAT included).

The applicable VAT rate is determined in accordance with the tax regulations applicable to the transaction.

The price applicable to the order is the price displayed to the customer before the order is validated.

The seller may modify prices at any time. Price changes do not apply to orders that have already been validated.

5. Order and Payment

Orders are placed online using the payment interface provided by Stripe.

Payment is due immediately when the order is placed.

The payment methods available are those offered by Stripe at the time of the order.

The order is definitively concluded once payment has been confirmed.

The customer provides the information necessary to process the order and issue the invoice.

An order and/or payment confirmation may be sent to the customer by e-mail.

6. Immediate Supply of Digital Content and Right of Withdrawal

The products sold are digital content supplied without a physical medium.

The customer may request that the supply of the content begin immediately after payment has been confirmed, before the expiry of the statutory withdrawal period.

In accordance with Article L.221-28 of the French Consumer Code, where the consumer has:

• expressly requested that performance begin immediately;
• acknowledged that they will lose their right of withdrawal as a result of such immediate performance;

the right of withdrawal can no longer be exercised for the digital content concerned.

The customer's consent and acknowledgement are collected during the ordering process through Stripe Checkout.

Confirmation of this agreement is provided to the customer on a durable medium.

The wording used during the order process is:

I request that the supply of my ebook begin immediately after my purchase and acknowledge that, as a result, I will lose my right of withdrawal.

This checkbox is not pre-selected.

7. Delivery of Digital Content

After payment has been confirmed and, where necessary, after the consent referred to in Section 6 has been obtained, the digital content is made available to the customer.

The content may be delivered by:

• a download made directly available after payment;
• a download link sent by e-mail.

No physical medium is shipped.

The digital content is deemed to have been supplied when the content has been made accessible to the customer in accordance with the arrangements specified at the time of the order.

8. Download and Access to Content

The customer must have equipment compatible with the format of the purchased ebook and Internet access allowing the content to be downloaded.

The available formats are indicated on the product page.

The customer is responsible for the software required to read the content.

Download mechanisms may be subject to technical security measures intended, in particular, to prevent fraudulent use.

Purchased files are intended for the customer's personal use and must not be made available to third parties, subject to mandatory rights provided by law.

9. Intellectual Property

The ebooks and other content offered on the website are protected by intellectual property laws.

Purchasing an ebook grants the customer a personal, non-exclusive right to use the purchased content.

The purchase does not transfer any intellectual property rights to the customer.

Except where permitted by law or with the prior authorization of the rights holder, the customer is prohibited from, in particular:

• reproducing or copying the content beyond the statutory exceptions;
• distributing or making the content available to third parties;
• reselling the content;
• publishing the content on the Internet;
• making the content available on a file-sharing network.

These restrictions do not affect the rights granted to consumers under mandatory provisions of the French Intellectual Property Code.

10. Legal Warranties

Consumer customers benefit from the legal warranties applicable to digital content, including the legal warranty of conformity and the warranty relating to hidden defects, under the conditions provided for by French law.

In particular, the seller is required to provide digital content that conforms to the contract and is liable for defects in conformity under the conditions provided for by the French Consumer Code.

The customer may report any problem concerning purchased content to:

Customers are advised to specify the product concerned and describe the problem encountered.

These GTCS do not limit the rights granted to consumers under the applicable legal warranties.

11. Liability

The seller takes reasonable measures to ensure access to the website and the supply of digital content.

However, the seller cannot be held liable for temporary inability to access the website or content resulting, in particular, from:

• a failure of the customer's Internet connection;
• incompatibility of the customer's hardware or software;
• a temporary failure of a technical service provider;
• force majeure;
• an event reasonably beyond the seller's control.

The seller shall not be liable for any use of the content contrary to these GTCS or to applicable law.

These provisions shall not have the effect of depriving consumers of mandatory rights granted to them by law.

12. Complaints

For any question, difficulty concerning an order, or complaint, the customer may contact the seller at:

13. Applicable Law and Disputes

These GTCS are governed by French law.

In the event of a dispute, consumers are invited to contact the seller beforehand in order to seek an amicable solution.

If no amicable resolution can be reached, the consumer may refer the matter to the competent consumer mediator under the conditions provided for in Section 13.

The consumer retains the right to bring proceedings before the competent courts in accordance with the applicable legal rules.

14. Amendments to the GTCS

The seller may amend these GTCS in order to take into account, in particular, changes to the website, the products offered, or applicable regulations.

The GTCS applicable to an order are those in force at the time the order is placed.
